Finding the “right lawyer” to represent you is a challenging process. Once you have found the”right lawyer,” you should ask for a written fee agreement explaining what the lawyer has promised to do for you and what it is going to cost.
Each couple I meet with is special, each with their own estate planning needs and as a result legal fees can vary. Some couple have more assets, property in other states, prior marriages, larger life insurance policies, businesses, specific wishes about who they would or would not like as guardians or who they would like to be involved in their children’s lives should something happen to both parents, instructions on how they would like their children raised, married to a non US Citizen, how much time they would like to allocate chatting walking through their documents together and doing revisions,, etc. As such the range for services rendered can vary greatly. My GOAL is always to keep things within your budget so you are comfortable with the fees and experience.
What should also be taken into consideration is which documents you are having drafted. Are you looking for just a Will? What types of provisions will your Will contain? Would you like to do any trust work for your minor children? What about a Physician Advance Directive, HIPPA, Durable Power of Attorney, etc.?
Loads of things to think about and discuss at your initial appointment.
But honestly, what it really comes down to is whether you and your spouse/partner would be comfortable working this person as your lawyer. Do you feel your potential attorney is approachable, knowledgeable and responsive? Ask yourself whether or not she or he gave you clear and direct information. Will they be available in an emergency? Consider if the attorney spoke knowledgeably and with a minimum of legal terms. Think about whether this lawyer understands and shares your goals. I hope so. As my client, I am hoping you will be an active and involved co-participant.
The importance of creating a comfortable working relationship with your lawyer cannot be underestimated. The road to obtaining the legal services you are seeking may be long, and it will take a considerable amount of teamwork to get there. If you make the commitment to find an experienced lawyer with whom you can work jointly you will be well on your way to the best possible result.
