Elements of Estate Planning Documents for People with Pets: The idea of creating legally enforceable documents that ensure our family pets are always taken care of is relatively new.
Leona Helmsley, left millions of dollars for the care of her dog, Trouble. When she did so she not only created quite the legal fuss but also, thankfully, brought to the attention of loving pet owners the importance of planning for their pet’s care if something unexpected happens (even for just a day or two).
Three Legal Documents for Pet Protection:
Wills. A simple provision in your Will can identify someone to care for your family pet and arrange for their financial support. However, your Personal Representative has no responsibility to ensure that the funds are being spent appropriately for your family four or two legged friend.
Pet trusts. If you are concerned that the person taking over the care of your pet might spend the money unwisely you can opt for a Pet Trust instead.
Pet protection Agreements: Finally, you may have the opportunity to draft a Pet Protection Agreement whereby you can name a caregiver, leave instructions and even funds ensuring that your family friend has a smooth transition to their temporary or permanent home.
Our pets are always there for us. We can and should make sure that we are always there for them as well.
